DNR Memorandum on Solar Facility Registration

MEMORANDUM

Act No. 555 of Louisiana’s 2022 Regular Legislative Session, authorized the Louisiana Department of Natural Resources (“LDNR”) to adopt regulations to implement a new regulatory program governing the decommissioning of solar generation facilities and requiring a permit issued by LDNR prior to the construction and/or operation of a solar generation facility in Louisiana. This notice provides guidance to those owners/operators of such facilities.

LDNR has recently begun the rulemaking process pursuant to the Louisiana Administrative Procedures Act (La. R.S. 49:950, et seq.) (“APA”). These rules shall not be final until promulgated in accordance with Louisiana’s APA. Therefore, until those rules are final and enacted, LDNR cannot require owners/operators of solar power generation facilities to comply with regulations associated with Act No. 555 of 2022.

In anticipation of the regulatory program startup, LDNR is requesting all solar power generation facilities to register with LDNR by completing the attached form. Act No. 555 of 2022 authorizes an exemption to certain regulatory fees if the owner/operator registers with LDNR by January 1, 2023. LDNR deems completion and submission of the attached form by January 1, 2023 as meeting this requirement.
