WHO OWNS EAST BATON ROUGE'S GROUNDWATER?

Groundwater is a public resource; everyone has a right to its use. Louisiana law, however, recognizes what is known as the "rule of capture," which means that once groundwater is pumped to the surface, or "captured" in legal terms, it belongs to the individual landowner and can be used for whatever purposes that may be needed: home or commercial use, agricultural irrigation, or industrial processes. The State of Louisiana does not permit groundwater use, although it may impose conditions on the installation of new water wells based on a scientific evaluation of any potential impact to already existing wells or aquifer sustainability in a given area.
